You acknowledge and agree to obtain express consent from your customers and contacts before sending them text messages through the Platform. Consent must comply with the Telephone Consumer Protection Act (TCPA) and other applicable laws.

You are solely responsible for ensuring your use of the Services complies with all applicable laws and regulations, including but not limited to:

• TCPA (Telephone Consumer Protection Act)
• CAN-SPAM Act (if applicable)
• State and local texting regulations

You must not send unsolicited, unlawful, or spam text messages using the Platform.

• Opt-In: You are required to obtain affirmative opt-in consent from your customers before sending text messages.
• Opt-Out: Customers must be provided with clear instructions on how to opt-out of receiving text messages, such as replying “STOP.” The Platform will process opt-out requests automatically, and it is your responsibility to honor them promptly.

You agree not to send any messages containing:

• Fraudulent or misleading content
• Harassment or spam
• Hate speech or discriminatory language
• Obscene, defamatory, or illegal content

Standard messaging and data rates may apply. Your end users are responsible for any charges incurred from their mobile carrier for text message delivery.

The Platform does not guarantee the delivery of text messages. Factors like carrier restrictions, network outages, or technical issues may affect delivery.

• You are responsible for the accuracy of all content sent through the Platform.
• You agree not to abuse the Services or use them for any illegal or unethical activities.

The Platform adheres to strict data security and privacy standards. Please review our Privacy Policy for information on how we handle personal data.

You agree to indemnify and hold Business Matrix Solutions, LLC dba MyBusinessPortal.Cloud harmless from any claims, damages, or penalties arising from your use of the Services, including violations of these Terms and Conditions or applicable laws.

Business Matrix Solutions, LLC dba MyBusinessPortal.Cloud reserves the right to suspend or terminate access to the Services at its sole discretion if you violate these Terms and Conditions or applicable laws.
